Derkach v. Groysman: the case will be considered by the Court of Appeal

People’s deputy Andrii Derkach and his colleagues – the MPs Valeriy Dyubil and Yuriy Odarchenko are suing the Court of Appeal with a demand to Groysman to make a submission of the Minister of Health to the Rada. He said this to reporters.

According to Derkach, the District Administrative Court declined the claim against the Prime Minister, but the MPs appeal.

“The District Administrative Court of Kyiv declined the suit against the Prime Minister on submission a candidacy of the Minister of Health to the Verkhovna Rada for unforeseen reasons. Groysman should be responsible for the collapse of the Ukrainian health care system. We will check how long the Prime Minister and judges can wipe their feet on the Constitution – see you at the appellate court”, said Derkach.

He also stressed that the deputies who filed the lawsuit have absolutely constitutional requirements: the Prime Minister should comply with the direct rule of the Basic Law and submit a candidacy of the Health Minister to the Parliament.

“The case was heard by the judge Pashchenko, appointed in May this year. In the media he is known as a “authority’s pocket judge”. “His decisions are evidence of complete lawlessness in the judicial system of the country. Pashchenko did not even give an explanation as to why he rejected the claim. “Only that the claim was dissmissed for political reasons. There is no intelligible justification for such actions”, believes Derkach.

The MP said that law enforcers will check information on the pressure on the court by the Cabinet, as well as lawyers and activists will pay attention to studying the way of life and motivations of judge Pashchenko.

“I do not know who has called the judge and how much money he could receive to make the case hushed up, but one thing is certain – Groysman is afraid to answer for his actions. In due time I won the court even against Yanukovych when he was the Prime Minister. However, the first decision of the “reformed” Kyiv District Administrative Court is a shame for the country”, summarized Derkach

As you may know, the MP of Ukraine Andrii Derkach together with his colleagues filed a lawsuit against the Prime Minister of Ukraine, demanding to submit an application to the Verkhovna Rada for the appointment of the Minister of Health. Ulyana Suprun has been appointed as acting Minister for more than a year and is conducting one of the most important reforms. Deputies are sure that the absence of the appointment of a Minister is a way to avoid responsibility for the failure of medical reform.
